Terms & Conditions

• "Services" means the Cygnus corporate travel management platform, including all features, tools, and related services.
• "User" means any individual who accesses or uses the Services.
• "Customer" means the organisation or company that has entered into a subscription or service agreement with Cygnus.
• "Content" means any data, text, files, or other materials submitted through the Services.
• "Supplier" means airlines, hotels, car rental companies, and other travel service providers accessible through the platform.

To use our Services, you must be at least 18 years of age and have the legal capacity to enter into a binding contract. By registering, you represent that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account at support@bookcygnus.com.

You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not:

• Use the Services in any way that violates applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the Services or related systems.
• Transmit any harmful, offensive, or disruptive content.
• Reverse engineer, decompile, or disassemble any part of the Services.
• Use automated tools (bots, scrapers) to access the Services without our express written consent.
• Resell or sublicense the Services without written authorisation from Cygnus.
• Interfere with or disrupt the integrity or performance of the Services.

Cygnus acts as a technology platform that facilitates travel bookings with third-party Suppliers. When you make a booking through our platform:

• The contract for the travel service is between you (or your organisation) and the Supplier.
• Cygnus is not responsible for the acts, omissions, or failures of any Supplier.
• Fares, rates, and availability are subject to change and are controlled by Suppliers.
• Cancellations, changes, and refunds are subject to the Supplier's terms and conditions.
• Cygnus will use reasonable efforts to process booking requests but does not guarantee availability.

Access to the Cygnus platform is subject to subscription fees as agreed in your service agreement. All fees are exclusive of applicable taxes unless stated otherwise.

Payments for travel bookings made through the platform are processed in accordance with your organisation's configured payment methods. Cygnus uses industry-standard payment processors and does not store full payment card details on our servers.

We reserve the right to modify our pricing with reasonable notice. Continued use of the Services after a price change constitutes your acceptance of the new pricing.

All content, features, and functionality of the Services — including but not limited to software, text, graphics, logos, and user interfaces — are owned by Cygnus or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Services solely for your internal business purposes. No other rights are granted.

You retain ownership of any Content you submit through the Services. By submitting Content, you grant Cygnus a limited licence to use it as necessary to provide the Services.

Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in the Privacy Policy.

Each party agrees to keep confidential all non-public information disclosed by the other party in connection with the Services and to use such information solely to perform obligations or exercise rights under these Terms. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CYGNUS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Cygnus does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy or completeness of any information provided through the Services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYGNUS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

IN NO EVENT SHALL CYGNUS'S TOTAL LIABILITY TO YOU EXCEED THE FEES PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Cygnus and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any third-party rights.

Either party may terminate access to the Services upon written notice if the other party materially breaches these Terms and fails to cure such breach within 30 days of receiving written notice.

Cygnus may suspend or terminate your account immediately if we believe you are engaged in fraudulent, abusive, or illegal activity. Upon termination, your right to use the Services ceases immediately.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

Before initiating legal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

• Entire Agreement: These Terms, together with the Privacy Policy and any applicable service agreement, constitute the entire agreement between you and Cygnus.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.
• Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of future enforcement.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
